Whilst I am reluctant to comment on court/tribunal cases based upon a news article (ie without reading the court transcripts), this dismissal does appear to be somewhat excessive! I would have thought that a reasonable person might expect that, if their manager has given a sandwich to them, appropriate permission has been granted.
Assuming that the sandwich was taken in all innocence (and the judge questioned the fairness of the dismissal), being sacked for such an incident after three years of loyal service must be very hard to take. Let’s hope she was compensated appropriately.
Just goes to show that you cannot be too careful!
